A Pierce County resident has filed a complaint in Pierce County Superior Court challenging the Dec. 6 run off election.
Christopher Cason Carbaugh, local businessman and former candidate for the Georgia State House of Representatives, filed the 10 page complaint last week.
Carbaugh challenged the use of county’s current voting system and called for a referendum on implementing a new hand counted paper ballot locally.
Carbaugh says in the complaint that he voted in the U.S. Senate run-off Tuesday, Dec. 6 in which Incumbent Democratic Senator Raphael Warnock fended off a challenge from Republican and former UGA football star Herschel Walker.
Carbaugh said he cast his ballot on the Dominion voting machine currently in use in Pierce County and across the state of Georgia and printed a copy of his ballot.
He said he could see his selection on the ballot, but also saw a QR code that he could not read. He said he inquired with a poll worker and was told the QR code would be scanned recording his vote and casting his ballot.
Carbaugh alleges in his complaint that the current system of casting ballots is “non conforming to the standards of Georgia law”.
No plaintiff or defendant was recorded on the filing and no attorney of record was listed.
Carbaugh filed the complaint as a qualified registered voter in Pierce County and the State of Georgia.
Efforts to reach Carbaugh for comment were unsuccessful.
Elections Superintendent Leah Ritch says she is aware of the complaint, but declined comment.
Clerk of Court Thomas Sauls says the complaint will be placed on the docket and will likely be heard before a Superior Court Judge after the first of the year.
