NPD arrest two Federal agents at local eatery

NAHUNTA — Two Department of Homeland Security special agents were arrested and charged by officers with the Nahunta Police Department following a incident here at Burger King.

Based on physical, testimonial and video evidence of the Friday, September 13 incident, agents Antonio Lee Whaley, 38, of Port Wentworth, Ga., and Hillary Audra Nielson, 34, of Savannah were taken into custody and charged with Simple Battery and Criminal Trespass.

Both were transported to the Brantley County Jail for booking procedures. Warrants were obtained through the Magistrate Court of Brantley County. Whaley’s and Ms. Nielson’s supervisors with the Department of Homeland Security were contacted.

According to the Tuesday, September 17 press release of Nahunta Police Chief Brad Todd, officers with the NPD and deputies with the Brantley County Sheriff’s Office were dispatched at approximately 7 p.m., to 13200 Cleveland Street (Burger King) in reference to a dispute.

Law enforcement personnel were advised a black male, identified as 18-yearold Delvin Lamont Denton of Waycross, had an AR-15 style rifle and he was leaving in a black Jeep.

Officers and deputies’ arrived on scene and observed a vehicle (Jeep) with a subject (Denton) matching the description leaving the parking lot. A traffic stop was conducted in the parking lot (Bennett’s Pharmacy) adjacent to Burger King.

Law enforcement obtained a statement from Denton as to what occurred, as well as statements from both Whaley and Ms. Nielson.

After gathering statements from the three, officers and deputies reviewed the video from Burger King depicting the actual events which took place.

The preliminary investigation revealed Whaley and Ms. Nielson were at Burger King to purchase a cell phone from Denton. Ms. Nielson had purchased another cell phone from Denton approximately two weeks prior to the Friday the 13th incident.

An argument ensued regarding the first purchase. Denton, who was actively trying to leave the restaurant, was physically kept from leaving the scene by Whaley and Ms. Nielson.

Denton’s necklace was broken during the physical altercation. Whaley walked over to Denton’s vehicle and removed an AR-15 and placed it in the vehicle he and Ms. Nielson arrived in for the meeting.
